Joining Next Step Media is free — we take no cut of your TikTok earnings, gifts, or brand deals, ever. You keep ownership of your content. While you’re an active member, we can use clips from your LIVEs to promote the network, and we’ll take you out of our promo materials within 30 days if you leave. You can leave at any time, and we’ll release you within 30 days.
That’s a summary. The agreement below is the full text — it’s short, plain English, and it’s the version you’re signing.
This Talent Agreement (Agreement) is between Next Step Media LLC, referred to as the “Agency,” and the undersigned creator, referred to as the “Talent.” By signing below, the parties agree to these terms.
Membership in the Agency is free. The Agency does not take a commission, share, cut, or fee from the Talent’s TikTok earnings, gifts, or brand deals.
While the Talent is an active member of the Agency, the Talent grants the Agency a non-exclusive, royalty-free license to use the Talent’s name, likeness, videos, and clips from the Talent’s LIVE broadcasts solely to promote the Agency and its network. This permission applies to the Talent’s videos and LIVE clips during active membership and ends when the Talent leaves the network. After departure, the Agency will stop new uses and remove the Talent from Agency-controlled promotional materials within thirty (30) days, subject to reasonable technical limits on materials already distributed by third parties.
While the Talent is an active member, the Talent may identify their membership accurately. The Talent must not use the NXS name, logo, or other Agency branding in a way that falsely suggests endorsement, authorization, or a partnership beyond the Talent’s active membership. After membership ends, the Talent must stop presenting themselves as an active NXS member.
The Talent retains all ownership of original content. Leaving the Agency does not transfer ownership of the Talent’s content to the Agency. The Agency will remove the Talent from Agency-controlled promotional materials within thirty (30) days after departure, subject to reasonable technical limits on removing materials already distributed by third parties.
During membership and for one (1) year after it ends, the Talent agrees not to make knowingly false public statements intended to harm the Agency or its personnel. This section does not prohibit truthful statements, good-faith reports of concerns, legally protected activity, or communications required by law.
During membership, the Talent agrees not to directly solicit active NXS creators to leave the Agency and join a competing creator network. This restriction does not prohibit general public announcements or responding to an unsolicited request, provided the Talent does not encourage the creator to leave NXS.
Either party may end this Agreement at any time by giving written notice to the other party. The Talent may request release at any time. The Agency’s policy is to process release immediately whenever possible; in all cases, the Agency will release the Talent within thirty (30) days, consistent with the applicable TikTok release process.
This Agreement is governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
This Agreement states the full understanding between the parties regarding the subject covered here and replaces prior agreements on that subject. Any amendment must be in writing and accepted by both parties. If a provision is held unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
